Terms of Service

VesselNow software, VesselNow Cloud, trials, and integrations. · Privacy Policy

These Terms govern your use of VesselNow software, VesselNow Cloud (vesselnow.io), trials, subscriptions, and related services operated by GMTS Group (“GMTS”, “we”, “us”, “our”). Please read them carefully — especially sections on onboard data, third-party integrations, and maritime use.

At a glance

  • VesselNow is a decision-support and visualisation tool — not a certified navigation, safety, or alarm system.
  • Onboard data stays on your vessel unless you explicitly enable cloud features (e.g. FleetView sync).
  • Cloud account, license, and optional FleetView data for VesselNow Cloud is hosted in New Zealand in a private data centre environment.
  • Weather, charts, and hardware integrations use third-party services under their own terms; GMTS does not represent those providers.
  • Your license is personal to your organisation; misuse, redistribution, or circumvention may result in suspension.

1. Acceptance of terms

By accessing or using the Service, creating an account, activating a license or trial, or installing VesselNow on a vessel, you agree to these Terms and our Privacy Policy. If you use the Service on behalf of a company or vessel operator, you represent that you have authority to bind that organisation. If you do not agree, do not use the Service.

2. Description of the service

VesselNow is a maritime dashboard and guest-services platform that ingests, stores, visualises, and optionally shares vessel telemetry and operational data. The Service may include:

  • VN-Core — server software running aboard your vessel (Docker, Windows, or Linux).
  • VesselNow Cloud — vesselnow.io website, customer portal, license validation, optional FleetView hosting, and related APIs.
  • Client surfaces — Bridge, Guest infotainment, AMS, Hub, Device Bridge, and mobile companions where licensed.
  • Optional cloud sync — crew, guest content, schedules, and telemetry you choose to push from the vessel to VesselNow Cloud.

3. Where your data lives

3.1 Onboard (default)

By design, the primary copy of vessel sensor data, configuration, guest-service content, recordings, and operational logs resides on hardware you control aboard the vessel (or on your designated on-premises server). NMEA, NMEA 2000, SignalK, Victron, PLC, and similar feeds are processed locally unless you enable features that transmit data off-vessel.

  • You are responsible for securing onboard servers, networks, backups, and physical access.
  • License validation may contact VesselNow Cloud over HTTPS; that exchange is limited to license/trial metadata unless FleetView or other cloud features are enabled.
  • Deleting or reimaging onboard storage removes local data — GMTS cannot recover it from the vessel.

3.2 VesselNow Cloud (optional)

When you use VesselNow Cloud, FleetView, or portal features, we store associated account and vessel data in New Zealand, in a private data centre operated under contract with GMTS. We do not sell vessel telemetry or customer lists to third parties.

  • FleetView — position, heading, speed, and related telemetry you configure the vessel to upload, retained for dashboard history and alerting.
  • Guest & operational content — crew lists, schedules, menus, and similar data you edit in the portal or sync from the vessel.
  • License & billing records — contact details, vessel identifiers, activation events, and support correspondence.

4. Accounts, licenses, and trials

  • Use of the application requires a valid license or approved trial unless explicitly offered as a free tier.
  • License keys, FleetView tokens, and account credentials must be kept confidential.
  • Licenses are granted for the vessel, fleet, or organisation named in your order — not for unrestricted redistribution.
  • We may suspend or revoke access for breach of these Terms, license fraud, or non-payment.
  • Trial periods and feature limits are described at purchase or registration and may change with notice.

5. Acceptable use

You agree not to:

  • Reverse-engineer, decompile, or circumvent license or security controls except where law expressly permits.
  • Resell, sublicense, or host the Service for third parties without written authorisation.
  • Upload malware, probe systems without permission, or interfere with other customers.
  • Use the Service as the sole means of collision avoidance, chart navigation, or statutory safety compliance.
  • Misrepresent your identity, vessel, or affiliation when registering or requesting support.

6. Maritime and safety disclaimer

VesselNow is not a replacement for approved marine navigation equipment, ECDIS, radar, AIS transponders, GMDSS, or class-society-mandated alarm systems. Displays, alerts, and predictions are provided for situational awareness only. The master and crew remain solely responsible for safe navigation and vessel operations. Always cross-check information against official charts, notices to mariners, and onboard certified equipment.

7. Third-party services and integrations

7.1 No affiliation or endorsement

VesselNow integrates with equipment, protocols, and online services using public interfaces, APIs, published formats, or industry-standard protocols (including but not limited to NMEA 0183/2000, SignalK, Modbus, MQTT, REST, and vendor SDKs where licensed to you). GMTS is not affiliated with, sponsored by, or endorsed by any equipment manufacturer, chart provider, weather service, or software vendor unless we state otherwise in writing. Trademarks and product names belong to their respective owners.

  • Integration does not imply partnership, agency, or representation.
  • We do not warrant that third-party devices or services will remain compatible or available.
  • You are responsible for complying with each third party’s terms when you enable an integration or supply API keys.

7.2 Weather, forecast, and map providers

Weather overlays and forecasts may be sourced from independent providers that you select in settings. Availability, accuracy, and licensing are controlled by those providers. Examples include:

  • Windy (windy.com) — embedded or linked forecasts; subject to Windy’s terms of use and attribution requirements.
  • PredictWind — where configured with your PredictWind account or subscription; subject to PredictWind’s terms.
  • Ventusky, OpenWeatherMap, Open-Meteo, Yr.no, PassageWeather, and similar services — each governed by its respective provider terms.
  • Chart and tile layers (e.g. OpenStreetMap, satellite imagery) — subject to the tile provider’s licence.

GMTS does not guarantee forecast accuracy, timeliness, or coverage. Do not rely on VesselNow weather views as the sole basis for routing or safety decisions. You must obtain and maintain any API keys or paid subscriptions required by the provider.

7.3 Hardware and vessel systems

References to Victron, Cerbo, Mastervolt, CZone, Actisense, Maretron, Raymarine, Garmin, Simrad, B&G, and similar names describe compatibility with common marine equipment via standard or documented interfaces. GMTS does not represent those companies and is not responsible for firmware changes, warranty, or installation on your vessel.

8. Intellectual property

VesselNow software, documentation, VesselNow Cloud, logos, and related materials are owned by GMTS or its licensors. These Terms grant only a limited, non-exclusive, non-transferable right to use the Service according to your license. You retain ownership of your vessel data and content you upload; you grant GMTS a licence to host and process that content solely to provide the Service.

9. Disclaimer of warranties

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, GMTS disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted, error-free, or secure operation, or that data from sensors or third parties is accurate or complete.

10. Limitation of liability

To the maximum extent permitted by applicable law, GMTS shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profit, data, goodwill, vessel, cargo, or business opportunity, arising from use of the Service or reliance on displayed information — including weather, routing, or alarm outputs.

Our total aggregate liability for any claim relating to the Service shall not exceed the greater of (a) the fees you paid to GMTS for the Service in the twelve months before the claim, or (b) NZD $500 where the Service was provided free of charge (e.g. trial).

Nothing in these Terms limits liability that cannot be excluded under New Zealand law (including the Consumer Guarantees Act 1993 where it applies to consumers).

11. Indemnity

You agree to indemnify and hold GMTS harmless from claims arising from your misuse of the Service, violation of third-party rights, or breach of these Terms, except to the extent caused by GMTS’s gross negligence or wilful misconduct.

12. Changes

We may update these Terms. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance. Where required by law, we will provide additional notice.

13. Governing law

These Terms are governed by the laws of New Zealand. Courts in New Zealand have exclusive jurisdiction, subject to mandatory consumer protections in your country of residence.
